Filing of Highly Sensitive Documents

Effective immediately, parties who wish to file what are considered "highly sensitive documents" are responsible for submitting these documents on paper, together with a motion requesting that the subject documents not be included in the court's online records (PACER). Highly sensitive documents include (1) Classified documents (using the usual protocol for securing such information) and (2) Sealed documents involving: national security; foreign sovereign interests; criminal activity related to cybersecurity; terrorism; investigation of public officials; the reputational interests of the United States; and intellectual property, trade secrets, and sensitive commercial information likely to be of interest to foreign powers. Confidential and other protected information that does not rise to the above standard may be filed online using the court's procedures for filing sealed and redacted documents.
