Requests to Continue a Matter

Motions 

  • The moving party may make an informal request to continue a hearing by contacting the courtroom deputy at calendar@hib.uscourts.gov or (808) 522-8113 only if (i) no response has yet been filed or (ii) a response has been filed and all respondents have consented to a continuance. If the court approves the request, the moving party is responsible for promptly filing and serving a notice of the continued hearing, including any updated deadline for responses, and a certificate of service.

  • If not all parties have agreed to a continuance or if the party seeking a continuance is not the moving party, a motion to continue is required. The motion must recite the reason for the request, the effort to obtain the consent of all parties to a continuance, and the other parties' responses.

Trials and Evidentiary Hearings

  • Motion. A party to a trial or evidentiary hearing may request a continuance only by filing and promptly serving on all parties a motion to continue that recites the reason why a continuance is necessary and the proposed length of a continuance. 

  • Stipulation. If all parties agree to a continuance, the parties must file a stipulation that recites the reason for the request and the proposed length of the continuance. The filer must promptly advise the court that a stipulation has been filed for the court's consideration. If the stipulation is approved, the parties will be contacted with a new date. The parties must promptly upload a proposed order with the new date and any updated deadlines.  

Scheduling Conferences in Adversary Proceedings

  • Plaintiff's Request. A plaintiff may make one informal request for a continuance to the next available scheduling conference date by contacting the courtroom deputy at calendar@hib.uscourts.gov or (808) 522-8113. If the court approves the request, the plaintiff is responsible for promptly filing and serving on the defendant(s) a notice of the rescheduled conference. Note: Unless the court orders otherwise, a continuance does not extend the deadline for filing an answer or responsive motion. Any request for a further continuance must be made in person at the scheduling conference.

  • Defendant's Request. A defendant may make one informal request for a continuance to the next available scheduling conference date by contacting the courtroom deputy but only if the defendant has obtained the plaintiff's consent. If the court approves the request, the defendant must promptly file and serve a notice of the continuance on all parties. Absent consent by the plaintiff, a motion to continue, with an explanation of the reason for the request, is required. Note: Unless the court orders otherwise, a continuance does not extend the deadline for filing an answer or responsive motion. Any request for a further continuance must be made in person at the scheduling conference.
